These Terms of Service (“Terms”) are a binding agreement between you and SweetSpot Healthcare Supplies (Pty) Ltd, trading as Cocoa Health (“Cocoa”, “we”, “us”), for your use of the Cocoa mobile app and our websites, including cocoahealth.co.
By creating an account, downloading the app, or using our websites, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Cocoa.
1. Who we are
SweetSpot Healthcare Supplies (Pty) Ltd, 136 Jan Jonker Road, Windhoek, Namibia. Email: [email protected].
2. Cocoa is not medical advice
Cocoa offers educational and practical meal guidance for people living with diabetes. It is not a medical device, not a diagnosis, and not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified clinician before changing diet, medication, or glucose management. If you think you may have a medical emergency, seek emergency care.
3. Eligibility and accounts
You must be at least 13 years old to use Cocoa. If you are under the age of majority in your country, you may only use Cocoa with a parent or guardian’s involvement as required by local law.
You are responsible for your account credentials and for activity under your account. Sign in with Google, Sign in with Apple, and email/password accounts are for your personal use. Do not share your account. Notify us if you believe your account has been misused.
4. Subscriptions and payments
Some features may require a paid subscription or in-app purchase. Purchases made through the Apple App Store or Google Play are billed by Apple or Google, not by Cocoa directly. Their payment terms, billing cycles, and refund rules apply. We use RevenueCat to manage subscription status and entitlements, and to send subscription events to Meta for ad measurement, as described in the Privacy Policy.
Subscriptions may auto-renew until you cancel in your Apple or Google account settings. Deleting the app does not cancel a store subscription. Taxes, price changes, and trial terms will be shown at purchase where applicable.
5. Your content
You retain ownership of content you submit, including meal logs, photos, notes, and health-related entries. You grant Cocoa a worldwide, non-exclusive license to host, process, and display that content as needed to operate and improve the service.
If you allow it in the app, that processing includes sending your meal photos and meal details to OpenAI to estimate nutrition and suggest quests. What is sent, and what is not sent, is described in the Privacy Policy. If you do not allow it, we do not send that data.
You must only upload content you have the right to share. Do not upload illegal, infringing, or harmful material, or content that belongs to someone else without permission.
6. Acceptable use
You agree not to:
- Misuse, disrupt, or attempt to gain unauthorized access to Cocoa
- Reverse engineer or copy the app except as allowed by law
- Use Cocoa to provide medical care to others as if you were a clinician using our product as a device
- Scrape, spam, or use automated means in a way that harms the service
- Violate applicable law
7. Intellectual property
Cocoa, the Cocoa Health name and logo, and the app and website (excluding your content) are owned by SweetSpot Healthcare Supplies (Pty) Ltd or our licensors. These Terms do not transfer any ownership to you. You may not use our marks without permission.
8. Waitlist, guides, and website
Joining the waitlist or requesting a guide does not guarantee access, a particular feature, or a launch date. Website content is provided for general information.
9. Disclaimer of warranties
Cocoa is provided “as is” and “as available.” To the fullest extent permitted by Namibian law, we disclaim warranties of merchantability, fitness for a particular purpose, accuracy of nutritional or health-related output, and uninterrupted or error-free operation. Guidance generated by Cocoa may be incomplete or incorrect.
10. Limitation of liability
To the fullest extent permitted by Namibian law, SweetSpot Healthcare Supplies (Pty) Ltd and its directors, employees, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or health outcomes arising from your use of Cocoa. Our total liability for any claim relating to Cocoa will not exceed the amount you paid us for the service in the 12 months before the claim (or, if you only paid Apple or Google, the amount of those store charges attributable to Cocoa in that period). Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud or for death or personal injury caused by negligence where such a limit is not allowed.
11. Termination
You may stop using Cocoa and request account deletion through in-app controls where available or by emailing [email protected]. We may suspend or terminate access if you breach these Terms or if we discontinue the service. Sections that by their nature should survive (including intellectual property, disclaimers, and limitation of liability) will survive termination.
12. Changes
We may update these Terms by posting a new version on this page. The “Last updated” date will change. If you continue to use Cocoa after the update, you accept the revised Terms. If you do not agree, stop using Cocoa and delete your account.
13. Governing law
These Terms are governed by the laws of Namibia, without regard to conflict-of-law rules. Courts in Namibia have exclusive jurisdiction, except that we may seek injunctive relief in any jurisdiction to protect our intellectual property or the service.
